Booking terms
Terms and conditions
This is what we agree on when you book a guided day, a course or a workshop with me. It is written to be understood on the first read. If anything is unclear, ask me before you book and we will talk it through.
In force from September 2026. Version 1.
01Who provides the service
Guided climbing, courses and workshops are provided under the trading name eS'Lab Rock climbing, directly by Raúl Uberuaga, Chilean tax number 17.857.355-1, based at Ventisquero Snowy 1712, Puerto Natales, Última Esperanza province, Magallanes region, Chile.
Raúl Uberuaga is a guide and instructor accredited by the Chilean Association of Mountain and Climbing Guides under number 156, and the service is registered with Sernatur, the Chilean national tourism board, under registration number 78772.
For anything related to these terms you can write to contacto@eslabrockclimbing.cl or message WhatsApp +56 9 8251 9448.
02What this website is
This site is informative. The photographs, descriptions and durations on it describe the activity under normal conditions, but they are not a closed offer: the actual programme, date and price are agreed with you in writing before you book.
The weather forecast shown on the home page comes from an external service and is indicative only. It does not replace the guide's own assessment before or during the activity.
03How a booking is made
Bookings are made by WhatsApp or email. A booking is valid when four things have happened: we have agreed the programme, the date and the price; you have completed the medical form, the informed consent and the registration form; you have accepted these terms and conditions; and you have paid the deposit. Until all four are done, the date is not held.
By booking you declare that the information you give me about yourself and the people with you is true, in particular everything contained in the forms named above.
04Prices and payment
Prices are agreed with you before booking, are quoted in Chilean pesos, and include the guiding and the technical equipment that the programme calls for.
Unless we agree otherwise, they do not include transport, entry to the sectors, food, personal insurance, or personal gear on those programmes where that gear is your responsibility.
To hold the date a deposit of 50% of the total is paid. The balance is due before the activity starts. Payment is by cash or bank transfer.
05If you cancel or change the date
Travel plans move, I understand that. These are the rules:
- More than 3 days in advance: the deposit is refunded in full, or moved to another date at no cost.
- Less than 3 days in advance: the deposit is not refunded, because by then the date is held and I have turned down other bookings.
- If you do not show up on the agreed day without telling me, the service counts as provided and there is no refund.
If a documented event beyond your control stops you from coming, write to me. I look at each case on its own and find a reasonable solution.
06If I cancel or change the plan
This is Patagonia and the weather is in charge. I check the forecast and the state of the rock before every outing, and I decide on the morning itself. I may change sector, change the timing, or call the activity off if I judge that it cannot be done safely, and that decision is not negotiated at the crag.
If I am the one who calls it off, whether for weather, ground conditions, closed access or anything else on my side, you have two options: rebook at no cost or get back everything you paid. Your choice.
If the activity has already started and has to be stopped for safety, what we managed to do counts. If it is stopped within the first half of the planned day, you choose between rebooking the unfinished part at no cost or getting half of what you paid back. If it is stopped after that halfway point, the service counts as provided.
The reason it is not a full refund is that by then the day is committed: the guide, the equipment, the access permits and the transport are already paid for and the date is blocked.
07Climbing is a risk activity
This has to be said plainly. Rock climbing and moving in the mountains carry risks that cannot be removed entirely: falls, rockfall, sudden changes in the weather, uneven ground, cold, wind and wildlife. I work with certified equipment, certified belay technique and conservative margins, and my profession consists precisely of reducing and managing those risks, but I cannot promise you they disappear.
By booking you acknowledge that you understand the nature of the activity and that you take part voluntarily.
Nothing in this section releases me from answering for harm caused by my own negligence or by failing to meet my professional obligations.
08Your state of health
Before the activity you must complete the medical form and tell me about any medical condition, injury, treatment, allergy or pregnancy that could affect your participation or the safety of the group. I treat that information confidentially and use it only to adapt the day.
I may decline your participation, or stop it once started, if a condition appears that in my professional judgement makes the activity unsafe for you or for others. If that happens because of something you hid from me, there is no refund.
09During the activity
Throughout the day the guide's instructions are followed. This is not a formality: on rock, an instruction that gets ignored is an accident waiting to happen.
- You must use the safety equipment I give you at all times, and in the way I show you.
- You may not separate from the group or climb routes other than the agreed ones without my authorisation.
- Nobody takes part under the effects of alcohol or of substances that affect perception or balance.
- The environment is respected: your rubbish comes back with you, the rock and the vegetation are left alone, and wildlife is respected.
I may end your participation, with no refund, if you break these rules in a way that puts anyone at risk.
10Equipment
The technical equipment I provide is certified, inspected and retired at the end of its service life. You receive it in working condition and return it at the end of the day. You are responsible for equipment lost or damaged through clearly improper use, not for normal wear.
If you prefer to use your own gear, bring it and we will check it together before starting. I may decline equipment that does not meet minimum safety conditions.
11Access and permits
Payment for access to the sectors we visit is not included in the price. We do, however, handle the access request and buy the tickets to make it easier for you.
If the authority or the landowner refuses or closes access, section 06 applies: we rebook or I refund what you paid.
12Under 18s
People under 16 always take part accompanied by a parent or guardian, who must be present throughout the activity and authorise participation in writing.
Between 16 and 18 participation without an accompanying adult is accepted with written authorisation from the responsible adult, after we have talked the programme through.
13Insurance
The service does not include personal accident, rescue or trip cancellation insurance. I recommend taking out a policy before you come and checking that it expressly covers climbing and mountain activities: many ordinary travel policies exclude them, and that exclusion tends to surface exactly when you need the cover.
Should an accident or incident occur in the field, the guide will immediately activate the emergency response and rescue protocols established by eS'Lab Rock climbing in compliance with current regulations, providing first assistance and coordinating the evacuation with the relevant services.
Evacuation, medical care and transport costs are borne by the participant or their insurer.
14Image rights and promotional use
I usually take photographs and video during the activity. I send them to you afterwards at no cost.
By registering you authorise eS'Lab Rock climbing to use that material for promotional and advertising purposes, on the website, on social media and in print, without that giving you a right to financial compensation.
You can decline from the start, by ticking the relevant box on the registration form or telling me before we begin, and then nothing you appear in gets published.
You can also change your mind later. Write to contacto@eslabrockclimbing.cl and I will take the material down from the website and from the social accounts I run. On material already printed, or already shared on by other people, that is not always possible, and if so I will tell you straight.
15Your personal data
The details you give me, name, contact, age and relevant health information, are used only to organise and provide the service and to reply to you. I do not sell them and do not pass them to third parties, except where it is unavoidable in a medical emergency or required by law.
I keep them for as long as the relationship lasts and for as long as legal and tax obligations require. You can ask me at any time to show, correct or delete your data by writing to contacto@eslabrockclimbing.cl, under Chilean privacy law.
This site uses no tracking or advertising cookies. It loads fonts from Google Fonts and queries an external weather forecast service, and in both cases those services receive your IP address as a technical consequence of the connection.
16Liability
I am responsible for providing the service with the professional care expected of an accredited guide, and for harm arising from failing to do so.
I am not responsible for harm caused by matters outside my control, nor for harm arising from your failure to follow safety instructions, nor for loss of or damage to your personal belongings.
These terms do not affect the rights that Chilean consumer protection law, Law 19.496, gives you, which apply in any case.
17Complaints
If something did not go as you expected, write to me first at contacto@eslabrockclimbing.cl. I reply within ten working days and I would rather sort it out directly.
18Governing law and changes
These terms are governed by Chilean law. The courts of Puerto Natales, Última Esperanza province, are competent for any dispute, without prejudice to your right as a consumer to go to the court of your own domicile.
I may update these terms. The version that applies to your booking is the one published on the day you booked, and I will send it to you in writing if you ask.
